Estero man arrested after posting AI-generated image depicting injured Lee County sheriff

An Estero man was arrested in Lee County after deputies say he posted an artificial intelligence-generated image on social media that depicted Lee County Sheriff Carmine Marceno with a head injury while being shot at. The Lee County Sheriff’s Office linked the post to an Instagram account they say may have belonged to the suspect and say the image was posted as a comment under a post about the line-of-duty death of Lee County K9 Dundee.

According to the sheriff’s office arrest report, deputies connected the Instagram account to the suspect after a prior welfare check investigation earlier in July. During that earlier response, deputies said the man was located in a vehicle at Gulf Coast Town Center and was Baker Acted; investigators obtained messages and a photo tied to an Instagram account they later determined matched the account accused of posting the image.

Deputies located the man during a traffic stop and took him into custody; a cellphone and a firearm were found in the vehicle, and the phone number reportedly matched the number on the Instagram account. The sheriff’s office says the AI-generated image has since been removed.

The sheriff’s office charged the man with written or electronic threats to cause death or do bodily harm and with violating a domestic violence injunction. Sheriff Carmine Marceno and the agency described online threats as being taken extremely seriously and said their Intelligence Unit investigated and acted to hold the person accountable. Current case status: the suspect was arrested and charged per the sheriff’s office report.

All individuals accused of a crime are presumed innocent unless proven guilty in court.
