Osceola County Clerk of Court Kelvin Soto was charged with criminal contempt after a delay in sending a court-ordered release for a Kissimmee woman, records show. The case stems from a retail-theft prosecution of a 79-year-old Kissimmee resident whose charge was reduced to trespassing and who was ordered released from jail on July 20.

According to court filings, the woman’s public defender said the clerk had three days to transmit the release order to the jail but that the order was not sent until July 28. Soto was formally ordered to appear for an arraignment on Aug. 21 in connection with the contempt allegation. The filings identify the detained person as transient and a wheelchair user and link the delay in paperwork to the contempt charge.

Agency records list the clerk of court as the subject of the charge; the prosecution arises from the defense attorney’s assertion about the delay in executing the court’s release directive. The court docket shows the timeline: original release order dated July 20, transmission recorded July 28, and an arraignment scheduling entry on Aug. 21.
