Man Arrested After Gas-Station Altercation Leaves One Shot in Volusia County

Volusia County deputies arrested a 21-year-old DeLeon Springs man in connection with a shooting at a gas station on International Speedway Boulevard near Kepler Road. Deputies say they were called about a shooting Friday evening and later identified Jonathan Martinez as the alleged shooter; he was taken into custody at his home without incident on Wednesday and held without bond pending his first court appearance, the Volusia County Sheriff’s Office said.

According to the sheriff’s office, deputies responded around 6:45 p.m. to the Circle K location, where a 62-year-old DeLand man had been shot in the leg after an argument at a gas pump. The wounded man was transported to a hospital and was reported stable, the agency said.

The sheriff’s office described its investigation findings: the injured man was unarmed, repeatedly raised empty hands and at times disengaged and walked away, while Martinez allegedly armed himself early, advanced with a raised firearm on multiple occasions and shoved the victim while holding the weapon. The agency also reported the suspect told detectives he felt threatened and said he fired a single shot into the man’s leg to stop the situation from escalating.

Martinez faces a charge of aggravated battery with a deadly weapon, according to records cited by the sheriff’s office. As of the latest agency update, the case remains under criminal investigation and Martinez is awaiting his initial court appearance.

All individuals accused of a crime are presumed innocent unless proven guilty in court.
